Product Terms - Pay As You Go

INTRODUCTION

These Product Terms shall apply to each Agreement where the Confirmation Email includes one or more “Pay as you Go Campaign” (“PAYG Campaign”).Words and phrases used in these Product Terms shall have the same meaning as set out in the Master Service Terms unless otherwise set out below:

Category means the trade category applicable to the Agreement as set out in the Confirmation Email.

Deposit means an amount of up to two times (i.e. double) Your Monthly Budget for each PAYG Campaign.

Directory means a directory that Checkatrade publishes and distributes to homeowners containing information about tradespeople.

Fee per Lead means the fee for each Lead.

Lead Fees means the total Fees for all Leads.

Leads means contacts that Checkatrade delivers to You in any format, including but not limited to phone calls, messages, “Request a Quote” contacts, and/or clicks from the Platform to Your website via Our provided hyperlink.

Location means the postcode area(s) or district(s) You choose to receive Leads in.

Monthly Budget means the approximate amount You want to spend on Lead Fees each month for each PAYG Campaign, as set out in the Confirmation Email or as subsequently amended by You in the Members Area (or Trade App), subject to any maximum limit We may set from time to time. 

Maximum Monthly Charge means 120% of Your Monthly Budget.

  1. We shall deliver Leads to You in the Category (or Categories) within the Location(s).

  2. The number of Leads that We provide You is dependent on the following non-exhaustive list: how many reviews You get, Your Location(s), how up to date and appealing You make Your Profile and can be affected by factors such as seasonality, User demand and other market and environmental forces.

  3. Where there is available space within a Directory within the Location(s), We may, at Our discretion, automatically include You in that Directory to boost Your Leads. We will notify You prior to the inclusion and give You a reasonable opportunity to opt out of the inclusion.

  4. We shall not charge You for a discretionary inclusion in accordance with paragraph 3, but You will be required to pay for any Leads generated from the Directory in accordance with these Product Terms. Alternatively, You may purchase a confirmed space in a Directory, which shall be detailed in a Confirmation Email and subject to the Product Terms - Directory.

  5. The Fees for a PAYG Campaign will depend on the amount of Leads We provide. The Fee per Lead will vary depending on multiple factors including but not limited to the job value, channel, location, seasonality and supply/demand.

  6. You can see the current range of Fees per Lead within the Members Area. We reserve the right to vary the range of Fees per Lead at any time and such variation shall be confirmed by one of the following methods: (a) email; (b) through the Members Area; or (c) in the Trade App.

  7. You will set a Monthly Budget, which is a target amount and not a fixed limit. You may be charged Lead Fees above Your Monthly Budget in a monthly billing period, but the maximum amount You will be charged for Lead Fees in any monthly billing period will not exceed the Maximum Monthly Charge.

  8. You will not be charged for any Leads delivered to You which would cause the Lead Fees to exceed the Maximum Monthly Charge in a monthly billing period.

  9. We will invoice You for the Lead Fees monthly in arrears.

  10. The first invoice will be for Leads received for the period from the Commencement Date to one month after the Commencement Date (the “Billing Date”) and will be provided on (or shortly after) the Billing Date. Thereafter We will provide invoices on (or shortly after) the same Billing Date each month for the Agreement Term or any renewal thereof.

  11. Payment of the Lead Fees shall be due immediately on receipt of an invoice from Us.

  12. We may require a Deposit from You at the time of signing up for a PAYG Campaign and such Deposit if applicable will be invoiced to You on or around the Commencement Date. Our obligations in paragraph 1 are conditional upon payment of Your Deposit.

  13. If You increase Your Monthly Budget(s), We may require You to increase Your Deposit amount.

  14. If You fail to pay an invoice from Us within seven (7) Business Days of notice that the invoice is overdue, without prejudice to any other of Our rights or remedies, We may pay the invoice using the Deposit and require You to increase the Deposit to match Your then current Monthly Budget.

  15. Any failure to pay or increase the Deposit as required could lead to Suspension until such payment is received in full.

  16. Any Deposit We hold from You will be returned to You on termination of the Agreement.

  17. In the event of Termination of the Agreement, We reserve the right to payment of Lead Fees accrued prior to the date of Termination.
