Re-turfed back garden

Landscaping of rear garden - hard landscaping, laying lawn and planting trees and shrubs
Adam did an excellent job. However, three mature silver birch trees that Adam planted never established themselves and all died within three months. Initially Adam acknowledged that I was not at fault for the trees dying and said that I would not go 'out of pocket'. However after several months he changed his view and said that he would not compensate me at all for the trees. He did say though that he would remove the dead trees for me. I continued to press for some compensation but Adam stopped responding to call and text messages. When we supplied and planted 3 x silver birch trees I gave my client the advice on how to look after the trees and the best way to water them in. I offered him a maintenance schedule until the trees were established as we have various contracts in place with customers for routine maintenance. He decided not to go with this and not take my advice. When he contacted me for a refund i did agree until he asked for different trees all together as he wanted to try something else. When I sought legal advice they said this was totally unreasonable hence not replacing them.
