PRODUCT TERMS – TRADE CARD
INTRODUCTION
1. The Trade Card is a Service provided by Checkatrade both terms are defined in our Master Service Terms.
2. These Terms shall apply in addition to the Master Service Terms to the provision of the Trade Card Product by Checkatrade on or after 28th March 2025.
3. Words and phrases used in these Terms shall have the same meaning as set out in the Master Service Terms unless otherwise set out below:
Area means the geographical area that the Trade Card will be distributed to as set out in the Confirmation Email.
Box means Your allocated advertisement space on the Landing Page and Trade Card as more particularly set out in the Confirmation Email.
Fees means the fees for the Box set out in the Confirmation Email.
Landing Page means the Checkatrade dedicated website URL for the Trade Card that hosts the Box.
Plan Agreement means the Fixed Plan Services as further set out in the Product Terms – Fixed Plan or PAYG Services as further set out in the Product Terms – Fixed Plan.
Trade Card means the card that We publish and distribute to the homeowners in the Area, hosting the Box, as set out in the Confirmation Email.
Trade Card Product means the Trade Card and Landing Page.
Works means any work quoted for, carried out or to be carried out by You for a Customer, via the Trade Card Product and includes the supply of a service and/or the supply of goods and/or materials and/or the installation of those goods.
4. Unless otherwise set out in the Terms or agreed between Us and You, the Trade Card Product is non-cancellable and non-refundable.
TERM AND TERMINATION:
5. The start date and the end date (“Initial Term”) of the Box shall be set out in the Confirmation Email.
6. After the Initial Term, the Trade Card Product shall automatically renew for further terms of 30 days, until terminated by You giving Us 30 days’ notice by contacting Our customer service centre or Your account manager (if applicable) by telephone or, if available, within the Members Area or on our Trade App.
7. We may terminate the Trade Card Product by giving You 30 days’ notice.
8. Your Agreement for the Trade Card Product shall be automatically suspended or terminated if Your Approved Product or Master Service Terms are suspended or terminated for any reason.
9. If Your Plan Agreement is terminated or expires Your Box will be removed immediately from the Landing Page and any subsequent Trade Cards.
10. Paragraph 9 is without prejudice to Your obligation to pay for the Fees, except where termination is by You due to Our breach of the Agreement.
OUR OBLIGATIONS
11. We shall include:
a) a Quick Response code (QR Code) linked to the Landing Page in the Trade Card; and
b) Your Box on the Landing Page as set out in the Confirmation Email.
12. We may from time to time at Our sole discretion and without notice to You amend the boundaries of the Area.
13. We provide no warranties, representations or guarantees as to the performance of a Box, including but not limited to the amount of impressions, clicks or contacts that You may receive as a result of a Box or whether the Trade Card will be received by all or any particular households within the Area.
14. After the Initial Period, We may increase the Fees by notifying You with 30 days’ notice in a Variation Email. If You do not agree to such increase, You may terminate the Box within 30 days of such notice.
YOUR OBLIGATIONS
15. You warrant and represent that You have the ability to respond appropriately to leads which:
a) pose a direct threat to personal safety or significant property damage; and
b) require prompt attention.
16. By signing up for the Trade Card Product, You agree to meet the minimum acceptance rate of the leads received via the Trade Card Product as set out in the Confirmation Email (“Acceptance Rate”).
17. We will review Your compliance with clause 16 on a 30-day rolling basis. If Your average acceptance rate in the 30-day period drops below the required Acceptance Rate, We reserve the right to terminate this Agreement and Your Box will be removed immediately from the Landing Page and any subsequent Trade Cards. In such cases, You will not be entitled to any refund of the Fees already paid.
18. If You believe Your ability to respond to leads may be impacted, You may notify Us at any time that You wish Your Box to be temporarily removed from the Landing Page and any subsequent Trade Cards (“Temporary Removal”) by contacting Our customer service centre or Your account manager (if applicable) by telephone or, if available, within the Members Area or Trade App. Please note that during any period of Temporary Removal, You will remain liable for all applicable Fees under this Agreement and You will not be entitled to any refund of the Fees already paid.
PAYMENT
19. Unless agreed otherwise at point of sale and set out in the Confirmation Email, we will invoice You for the Fees monthly.
20. Payment of the Fees for the Trade Card Product shall be due immediately on receipt of an invoice from Us unless We agree otherwise in writing.
